김정은(金正恩) 고발장 ◆김정은 고발 취지설명 기자회견 일시: 2019.03.27.(수) 오전 11시 장소: 자유민주국민연합 강당(종각역 11번출구, 종로구 종로 11길 10) 주최: 대한민국수호비상국민회의, 대한민국수호비상국민회의, 대한민국수호 예비역장성단, 나라지킴이고교연합, 전군구국동지회, 자유민주국민연합, 한반도인권과통일을위한변호사모임,북한민주화위원회외 56개 단체 ◆김정은 고발장 접수 기자회견 일시: 2019.03.28.(목) 오전 11시 장소: 대검찰청(대검찰청 정문, 서초역) 주최: 대한민국수호비상국민회의, 대한민국수호비상국민회의, 대한민국수호 예비역장성단, 나라지킴이고교연합, 전군구국동지회, 자유민주국민연합, 한반도인권과통일을위한변호사모임,북한민주화위원회, 자유연대, 자유대한호국단, 턴라이트 외 56개 단체 1. 대한민국 수호 비상국민회의(상임대표 박관용)∙대한민국 수호 예비역 장성단(운영위원장 이석복)∙나라지킴이 고교연합(대표 김일두)∙전군 구국동지회(대표 정광작)∙자유민주국민연합(집행위원장 이희범) 및 한반도의 인권과 통일을 위한 변호사 모임(대표 김태훈) 등 대한민국의 40개 보수 애국 시민단체들과 북한민주화위원회(위원장 허광일)를 비롯한 16개 탈북인 단체들은 2019년3월27일(수) 공동으로 2007년12월21일자로 제정, 공포된 대한민국의 <국제형사재판소 관할 범죄의 처벌 등에 관한 법률>에 의거하여 북한의 독재자 김정은(金正恩)을 체포하고 동 법이 규정하고 있는 ‘반인권 범죄’ 범행 혐의를 엄중하게 수사하여 처벌할 것을 요구하는 고발장 제출을 위한 기자회견을 개최합니다. 2. 주지하는 바와 같이 2013년4월9일 유엔인권이사회 결의 22/12호에 의하여 구성된 유엔북한인권조사위원회(Commission of Inquiry∙COI)는 1년 동안에 걸친 조사 활동 끝에 2014년2월7일 인권이사회에 보고한 뒤 공표한 “북한인권실태 조사보고서”에서 북한에서는 “국제형사재판소 구성을 위한 로마규정”(Statute of Rome of International Criminal Court)을 위반하는 “조직적이고 광범위하며 총체적”인 “반인도 범죄”가 국가적 차원에서 자행되고 있다는 방대한 조사 결과를 공표하는 것과 함께 이 같은 범죄 행위의 책임은 북한이라는 국가, 그리고 북한의 ‘최고 수령’인 김정은(金正恩)에게 있다면서 김정은을 비롯한 책임자들을 ① 국제형사재판소에 회부하던가 아니면 ② 유엔총회의 결의로 구성되는 특별법정에 회부하여 처벌할 것을 건의한 바 있습니다. 3. 그러나, ‘로마규정’은 동 규정이 규정하고 있는 ① 집단살해(Genocide), ② 반인도 범죄 (Crimes against Humanity), ③ 전쟁범죄 (War Crimes) 및 ④ 침략행위 (Crimes of Aggression) 등 4대 범죄 행위가 ‘로마규정’의 “서명국 영토 안”에서 “서명국 국민에 의하여 자행”되었을 때만 국제형사재판소가 능동적으로 이에 대한 재판관할권을 행사하도록 규정하고 있기 때문에 COI 조사보고서는 자동적으로 국제형사재판소에 회부될 수 없었다. 이에 따라 COI는 “유엔안보이사회가 요구하는 안건은 국제형사재판소에 회부될 수 있다”는 ‘로마규정’ 제13조 나항에 의거하여 유엔총회가 총회 결의를 통하여 COI 조사보고서를 안보이사회에 회부할 것을 건의했고 총회가 2014년부터 5년간 연속하여 COI의 건의를 수용하는 결의를 채택함에 따라 2015년에서 2017년 까지 3년에 걸쳐서 안보이사회에서 COI 조사보고서의 처리 문제가 토의되었으나 거부권을 보유한 중국과 러시아의 비협조로 김정은의 국제형사재판소 회부는 실현되지 못하고 있습니다. 4. 한편, ‘로마규정’의 123개 서명국의 하나인 대한민국에서는 국회의 통과를 거쳐서 “국제형사재판소 관할 범죄의 처벌 등에 관한 법률”이 2007년10월21자로 공포, 시행되어서 지금에 이르고 있습니다 [2011년4월12일 일부 개정]. 이 법은 제8조(집단 살해죄) ①항에서 “국민적ㆍ인종적ㆍ민족적 또는 종교적 집단 자체를 전부 또는 일부 파괴할 목적으로 그 집단의 구성원을 살해한 사람은 사형, 무기 또는 7년 이상의 징역”에, 그리고 ②항에서 상기 집단 구성원에 대하여 “㈎ 중대한 신체적 및 정신적 위해를 가하는 행위”∙“㈏ 신체의 파괴를 초래하기 위하여 계획된 생활조건을 고의적으로 부과하는 행위”∙“㈐ 집단 내 출생을 방지하기 위한 조치를 하는 행위”∙“㈑ 아동을 강제로 다른 집단으로 이주시키는 행위”에 대해서는 “무기 또는 5년 이상의 징역 형”에, ③항에서 “②항의 각호에 해당하는 행위로 사람을 사망에 이르게 했을 때”는 “사형, 무기 또는 7년 이상의 징역 형”에, 그리고 ④항에서 “① 또는 ②항의 죄를 선동한 사람은 5년 이상의 유기 징역”에 각기 처한다고 규정하고 ⑤항에서는 “① 또는 ②항의 죄의 미수범도 처벌한다”고 규정하고 있으며, 제9조(반인도 범죄) ①항에서 “민간인 주민을 공격하려는 국가 또는 단체∙기관의 정책과 관련하여 민간인 주민에 대한 광범위하고 체계적인 공격으로 사람을 살해한 자는 사형, 무기 또는 7년 이상이 징역형”에, ②항에서는 “㈘ 식량과 의약품에 대한 주민의 접근을 박탈하는 등 릴부 주민의 말살을 불러 올 생활조건을 고의적으로 부과하는 행위”∙“㈏ 사람을 노예화하는 행위”∙ “㈐ 국제법을 위반하면서 주민을 강제로 적법한 주거지에서 추방하거나 이주하도록 하는 행위”∙“㈑) 국제법을 위반하면서 사람을 감금하거나 기타의 방법으로 신체적 자유를 박탈하는 행위”∙“㈒ 구금 또는 자기의 통제 하에 있는 사람에게 정당한 이유 없이 중대한 신체적 또는 정신적 고통을 주는 행위”∙“㈓ 강간, 성적 노예화, 강제 매춘, 강제 임신, 강제 불임 또는 이와 유사한 중대한 성정 폭력 행위”∙“㈔ 정치적, 국민적, 민족적, 문화적, 종교적 자유, 성별 또는 그 밖의 국제법규에 따라 인정되지 않는 사유로 집단 또는 집합체 구성원의 기본적 인권을 박탈하는 행위”∙“㈕ 장기간 법의 보호로부터 배제시킬 목적으로 국가 또는 정치단체의 허가, 지원 또는 묵인 하에 사람을 체포한 사실, 인적 사항, 생존 여부 및 소재지 등에 관한 정보 제공을 거부하거나 거짓 정보를 제공하든지 이상의 정보를 제공할 의무가 있는 사람이 정보 제공을 거부하거나 거짓 정보를 제공하는 행위” 및 “㈖ 이상의 행위 이외의 방법으로 사람의 신체와 정신에 중대한 고통이나 손상을 주는 행위”를 한 사람은 “무기 또는 5년 이상의 징역 형”에 각기 처하는 것으로 규정하고 있고, 제15조(지휘관 등의 직무태만죄) ①항에서 “군대의 지휘관 또는 단체∙기관의 상급자로서 직무를 게을리 하거나 유기하여 실효적 지휘와 통제 하에 있는 부하가 집단살해죄를 범하는 것을 방지하거나 제지하지 못한 자는 7년 이하의 징역 형”에, ②항에서는 “과실로 ①항의 행위에 이르게 한자는 5년 이하의 징역 형”에, 그리고 ③항에서는 “군대의 지휘관 또는 단체∙기관의 상급자로서 그의 지휘와 통제 하에 있으면서 집단살해죄 등을 범한 하급자를 수사기관에 알리지 아니 한 사람은 5년 이하의 징역 형”에 처한다고 각기 규정하고 있습니다. 5. 특히, 이 법은 제2조 1호에서 이 법에서 사용하는 “집단살해 등”이라는 용어는 “제8조로부터 제14조까지의 죄를 망라”하는 것으로 규정하여 ‘집단살해죄’는 물론 ‘반인도 범죄’와 ‘전쟁 범죄’ 및 ‘침략범죄’ 등을 망라하는 것으로 명시했으며, 동조 4호에서 “이 법에서 사용하는 ‘외국인’이라는 용어는 ‘대한민국 국적을 갖지 아니 한 자를 말한다”고 규정하면서 제3조(적용범위) ⑤항에서 ”이 법은 대한민국 영역 밖에서 집단살해죄 등을 범하고 대한민국 영역 안에 있는 외국인에게 적용한다“고 규정함으로써 김정은을 포함하여 이 법의 소정 범죄를 범한 뒤 대한민국 영역 안으로 들어오는 북한인은 이 법에 의하여 처벌할 수 있다는 것을 명백히 하고 있습니다. 6. 2014년2월7일자 COI 조사보고서는 “몰살(extermination)," "살해(murder)," "노예화(enslavement)," "고문(torture)," "감금(imprisonment)” “강간(rape)," "강제 낙태와 기타 성폭력(forced abortion and other sexual violence)," 정치적∙종교적∙인종적∙성적 기반에 근거한 박해(politically∙religiously∙racially and sexually based persecutions)." "강제 이주(enforced transfer of population)" "강제 실종(enforced disappearances)"과 ”고의적으로 장기간의 기아 상태를 유발하는 비인간적 행위(inhumane acts of knowingly causing prolonged starvation) 등 북한이 자행하는 “반인도 범죄”들의 사례들을 유형에 따라 상세히 적시하는 한편, 이들 인권 범죄들의 책임은 북한의 정권 당국과 함께 북한의 절대적 독재자인 김정은에게 있음으로 그들을 국제형사재판소나 아니면 유엔총회가 설립하는 별개의 특별법정에 회부하고 ‘로마규정’의 관련 조항에 입각하여 단죄할 것을 요구하고 있습니다. 이 같은 북한의 잔학한 인권 유린 행위는 2014년의 COI 보고서 발표 이후에도 계속 자행되고 있다는 사실이 통일연구원과 북한인권정보센터 및 대한변호사협회가 각기 간행한 “2018년판 북한 인권 백서”와 2016년에 국가정보원 산하 국가정보전략연구소가 간행한 “김정은 정권 5년간의 실정(失政) 백서”에 상세하게 수록되어 있습니다. 7. 그런데, 지금 대한민국 영역 안에서의 문재인 대한민국 대통령과 김정은 사이의 ‘남북정상회담’이 추진되고 있다는 것이 언론에 의하여 공공연한 사실로 보도되고 있습니다. 이에 따라, 대한민국 수호 비상국민회의∙대한민국 수호 예비역 장성단∙나라지킴이 고교연합∙전군 구국동지회∙자유민주국민연합∙한반도의 인권과 통일을 위한 변호사 모임 및 북한민주화위원회 등 대한민국 헌법의 자유민주주의 가치의 수호와 북한의 민주화 그리고 자유민주주의에 입각한 한반도의 평화 통일 추구에 뜻을 함께 하는 56개의 애국 시민단체들과 탈북인 단체들은 연명하여 공동으로, 김정은이 대한민국 영토 안에 들어 올 경우, 대한민국 사직 당국이 즉시 그를 체포하여 ‘국제형사재판소 관할 범죄의 처벌 등에 관한 법률’의 관련 조항에 의거한 엄정한 수사를 통하여 이 법률의 소정 범죄 범행 사실을 밝혀 낸 뒤 관련 조항들에 의거하여 단호하게 법적 책임을 물을 것을 요구합니다. |
For Press release March 28, 2019 On Indicting Kim Jong Un on Charges of Human Rights Violations 1. Altogether 40 patriotic civic organizations of the Republic of Korea (ROK) that include the Emergency National Congress for the Safeguard of the ROK∙the Retired Generals for the Safeguard of the ROK∙the Alliance of High School Alumni for the Safeguard of the Nation∙the Comades-in-Arms of the Armed Services of the ROK to Safeguard the Nation∙the National Alliance for Freedom and Democracy and the Attorneys for Human Rights and National Unification as well as 16 organizations of North Korean defectors spearheaded by the Committee for Democratization of North Korea have banded together today, on March 28, 2019, jointly to submit a bill of indictment to the Metropolitan Office of Prosecution of the Special City of Seoul, requesting that, in accordance with pertinent articles of the 'Act on the Punishment of Crimes within the Jurisdiction of the International Criminal Court' (hereinafter The Act), a domestic law of the ROK that has been in force since December 21, 2007, the law enforcement authorities of the ROK arrest Kim Jong Un, North Korea's "deified" dictator, and criminally investigate and prosecute him on charges of human rights crimes that the United Nations (UN) Commission of Inquiry (COI) accused him as having committed in violation of a plurality of provisions in the 'Statute of Rome of the International Criminal Court (ICC)' (hereinafter The Statutue). 2. As is publicly known, the "COI on Human Rights in the Democratic People's Republic of Korea (DPRK∙North Korea)," a three-member investigative body created on April 9, 2013, by the UN Human Rights Council (HRC), undertook an extensive year-long probe into the human rights situations in North Korea, resulted in the submission to the UNHRC, and the subsequent publication, on February 7, 2014, of a landmark report on the findings of its probe, in which it concluded that "systematic, widespread and gross" crimes against humanity were found by the COI as "having been, and still being, committed" in North Korea in violation of The Statute. The COI held, in the report, not only the North Korean regime as a whole but also Kim Jong Un in person as well, in his capacity as the "omnipotent supreme leader" of the totalitarian state, responsible for the human rights atrocities committed by North Korea, recommending two options - one Kim Jong Un's referral to the ICC and/or the other trial of Kim Jong Un by an ad hoc special international tribunal to be established by the UN General Assembly - to hold him accountable for his crimes. 3. The Statute restrains the ICC, under Article #13/A/(a)&(b), from exercising criminal jurisdiction over any of the four criminal categories stipulated in The Statute - namely ① genocide, ② crimes against humanity, ③ war crimes and ④ crimes of aggression - unless the crimes were committed within the territory of a state signatory to The Statute by a national of the state signatory. Thus, as the ICC was unable to pick up, on its own, the case of Kim Jong Un for prosecution because of North Korea's being a non-signatory to The Statue, the ICC attempted to try a UN Security Council track under Article 13/B that authorizes the Council to consummate the referral of any issue to the ICC. However, while the report had managed to be placed on the Council's agenda, thanks to the courtesy of the General Assembly that made it an annual event to pass a resolution to that effect for four consecutive years, 2014∼2017, the Council failed, too, to consummate Kim Jong Un's referral to the ICC because China and Russia, North Korea's two veto-powered patrons in the Council, objected to having the North Korean dictator referred to the ICC. 4. In the meantime, as one of the 123 states signatory to The Statute, the ROK enacted on October 21, 2007, the "Act on Punishment of Crimes within the Jurisdiction of the ICC" (The Act), which still remains in force after a revision on April 12, 2011. By stipulating, in Article #2/A, that "genocide and other crimes" provided for in The Act, means "crimes stipulated in Articles #8 through #14," The Act makes it clear that it covers not only "crimes of genocide" but also the other three crime categories as well, namely "crimes against humanity," "war crimes" and "crimes of aggression." Furthermore, by stipulating, in Article #4, that the "foreigner(s)" in The Act means "any one who is not a national of the ROK," while stipulating at the same time, in Article #3, that The Act shall be "applied to a 'foreigner' who is physically inside the ROK territory after having committed crimes stipulated in The Act away from the territory of the ROK," The Act makes it irrefutably manifest that, in case Kim Jong Un, and his North Korean accomplices as well, set their feet on the "soil under the territorial jurisdiction" of the ROK. the law enforcement authorities of the ROK are authorized to arrest and prosecute them under The Act. 6. According to the COI report, North Korea was found ① subjecting all of its people, beginning from the time of their births, to a sweeping system of brainwashing and surveillance resulting in the total deprivation of their fundamental freedoms of thought, conscience, speech and religion, ② imposing on them a total system of discrimination with respect to residence, occupation, education, food-rationing and marriage based on a songboon system, with its people classified on the basis of State-assigned social class and birth, ③ designating arbitrarily where to live and work on the basis of songboon, while forbidding not only movement within the country but also inflow of information and travel to and from foreign countries, ④ using songboon and class as determinants in food rationing, and ⑤ allowing a variety of state security outfits to arrest, detain and torture people at will together with the operation of the infamous political prison camps while ⑥ disallowing those ethnic Koreans deported to North Korea from Japan in late 1950s as well as those nationals of other countries, including South Korea and Japan, abducted to North Korea to return to their places of origin. 7. In addition to the COI report, there are other publications such as the three "White Books on Human Rights in North Korea" published in 2018 respectively by three highly credited ROK research institutes, the Research Institute on National Unification, the Center for Information on Human Rights in North Korea and the ROK Bar Association, plus the "White Paper on the 5 Years of Misrule in North Korea since Kim Jong Un's Rise to Power" published in 2016 by the Research Institute on National Security Strategies, a subordinate think tank of the National Security Agency, that have documented a long list, each, of human rights crimes committed by North Korea under Kim Jong Un. 8. The plaintiffs are mindful about the recent reports about the possibility that Kim Jong Un is likely to make a trip to the ROK with the purpose of conducting a meeting with President Moon Jae In of the ROK sooner or later. 9. It is in the context of a review of the situations of human rights in North Korea as well as the developments in the relations between the two sides of Korea that, today, the patriotic civic organizations of the ROK and organizations of North Korean defectors have decided, for the causes of preservation of freedom and democracy, the central constitutional values of the republic, peace on the peninsula and democratization of North Korea, to band together to jointly request the law enforcement authorities of the ROK to arrest Kim Jong Un instantly upon his entry into the territory under the jurisdiction of the ROK and subject him to a thorough investigation into the charges of crimes under The Act that he is accused to have committed, ultimately leading to a due punishment in accordance with the provisions of The Act. |
